PowerPic Photography – Terms and Conditions

Photographer: Refers to Landry Cabrel Ndjingoue, owner of PowerPic Photography.
Client: Refers to the individual or entity booking the photography services.
Images: Refers to all photographs, digital files, prints, or any other visual media created by the Photographer.

Booking Confirmation: A booking is confirmed only upon receipt of a non-refundable deposit, which is 30% of the total package cost.
Payment Schedule:
- Portrait and Engagement Shoots: Remaining balance due on the day of the shoot.
- Weddings and Events: Remaining balance due 7 days before the event.
Late Payments: A late fee of 5% of the total package cost will be applied for payments not received by the due date.

Client Cancellation: If the Client cancels the booking, the deposit will not be refunded. Cancellations must be made in writing.
Photographer Cancellation: In the unlikely event the Photographer needs to cancel, a full refund will be provided, including the deposit.
Rescheduling: Clients can reschedule once without penalty if notice is given at least 48 hours before the scheduled shoot. Subsequent rescheduling may incur additional fees.

Service Guarantee: The Photographer commits to providing professional photography services as per the agreed package.
Image Delivery:
- Portrait and Engagement Sessions: 2-3 days delivery.
- Family Sessions: 3-5 days delivery.
- Event Sessions: 5-7 days delivery.
- Wedding Sessions: 2-6 weeks delivery.

Image Rights and Usage: The Client will receive high-resolution images with personal usage rights. Commercial usage requires an additional agreement and fee.

Photographer’s Copyright: The Photographer retains copyright of all images created and may use them for promotional purposes, including on social media, website, and marketing materials.

Client’s Usage Rights: The Client receives usage rights for personal use only. Redistribution or sale of images is prohibited without written consent from the Photographer.

Damage or Loss: The Photographer is not liable for any damage or loss of images due to unforeseen technical failures or natural disasters. Liability is limited to the amount paid by the Client for the services.
Client Conduct: The Photographer reserves the right to terminate the shoot without refund if the Client or their guests exhibit inappropriate or unsafe behavior.

Consent: The Client agrees that the Photographer may use the images of the Client and attendees for portfolio, advertising, and promotional purposes without additional compensation.
Revocation: If the Client wishes to revoke the model release, a written request must be submitted. The Photographer reserves the right to charge a fee for the removal of images from promotional use.

Amendments: These terms and conditions may be amended by the Photographer with notice to the Client.
Governing Law: These terms and conditions are governed by the laws of Maryland, USA.

By booking with PowerPic Photography, the Client agrees to these terms and conditions.
